1.1 We are CarFinance247 Limited ("we", "our", "us", "CarFinance 247"), a private limited company registered in England and Wales under company number 6035525 and have our registered office at Universal Square, Devonshire Street North, Manchester M12 6JH.
1.2 www.CarFinance247.co.uk (the "Website") is a medium for providing information and access to you in respect of finance options which are made available by third party lenders.
1.3 On your completion of a finance application on the Website, you will then be prompted to create an account to access MyCarFinance247. MyCarFinance247 is an online platform that lists vehicles for sale by third party dealerships and other sellers ("Seller(s)") together with associated products and services.
1.4 If you access and use MyCarFinance247 you agree to be bound by and act in accordance with these Terms of Use. If you do not agree to these Terms of Use, you are not permitted to use or access MyCarFinance247.
1.5 Please note that the terms set out below are in addition to our Website Terms which will also apply to your use of MyCarFinance247, available at Website Terms of Use, and such Website Terms are hereby incorporated (form part of the same legal agreement between you and us).
1.6 In the event of any conflict between the Website Terms and these Terms of Use in relation to the use of MyCarFinance247, these Terms of Use will prevail (take priority).
2.1 When you register to use MyCarFinance247 you will be asked to create a password. Your password is unique to you and you must keep it confidential and not disclose it to anyone. You are responsible for all activities and enquiries that occur or are submitted through the use of your password. If you know or suspect that someone else knows your password you must notify CarFinance247 immediately by email to info@carfinance247.co.uk or by telephone at 0333 247 1247. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security requirements.
2.2 You may unsubscribe at any time from MyCarFinance247 through the unsubscribe hyperlink available in our account confirmation email or otherwise by accessing https://www.carfinance247.co.uk/contact-us choosing the "data" option and requesting that such access to MyCarFinance247 is removed.
2.3 You understand that MyCarFinance247 facilitates vehicle sales and transactions between you and the Sellers. We are not an auctioneer nor are we acting as an agent of you or the Seller and we have no continuing authority to negotiate, deal with, manage, conduct or conclude any sale or purchase on behalf of you or the Seller. If a transaction does not complete, CarFinance 247 will have no liability to you because of this.
2.4 Commentary and other materials posted on MyCarFinance247 are not intended to amount to advice that you as a buyer should rely on and we are not liable or responsible to you, for any reliance you place on materials presented to you through MyCarFinance247.
2.5 All prices listed on MyCarFinance247 by the Sellers shall be inclusive of VAT.
2.6 Before purchasing any vehicles, products or services we recommend that you confirm all information with the Sellers and make your own enquiries and searches about any vehicle, product or service with the Seller. CarFinance 247 has no liability for the accuracy or completeness of any information provided on MyCarFinance247.
2.7 If you choose to purchase a vehicle through MyCarFinance247, the legal contract for such purchase will be between you and the Seller and not with CarFinance 247 (unless expressly stated otherwise) ("Contract"). In such circumstances, we have no liability to you for any losses that you may incur as a result of purchasing a vehicle, product or service from a third party through MyCarFinance247. Before proceeding with the purchase of a vehicle, product or service you should read the Seller's terms and conditions fully and, where appropriate, take independent legal advice.
2.8 CarFinance 247 does not have possession of anything listed or sold through MyCarFinance247, and is not involved in, and bears no responsibility for, the actual transaction between you and the Sellers and you understand that the Contract is between you and the Seller.

2.10 Whilst we may provide relevant information to you from the Seller from time to time, such information is for information only. We have no control over, and are not in any way responsible for, the existence, quality, safety or legality of the vehicles, products or services listed.
2.11 The responsibility for compliance and enforcement of all obligations under the Contract is between you and the Seller.
2.12 Payment in respect of the other products or services of third parties will be made on the applicable terms and conditions of the relevant third party or Sellers and cannot be made via MyCarFinance247 or the Website (as applicable).
2.13 Should a dispute arise between you and the Seller you should each use your best efforts to resolve that dispute and all complaints and queries with respect to a transaction should be directed to the other party involved. We may (but shall have no obligation to) mediate between the parties to the Contract or to enforce the Contract. However, if you are unable to resolve your dispute with the Seller, please contact us by https://www.carfinance247.co.uk/contact-us.
3.1 From time to time, we may restrict access to some parts of MyCarFinance247, or our entire Website, to users who have registered with us. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use or we believe your user identification has been compromised or otherwise believe there is a security risk presented by use of such user identification. We may also require you to change your password or suspend your MyCarFinance247 account and we will communicate the same to you in writing, using the contact details you have provided.
3.2 If you breach these Terms of Use, or we have a justifiable reason to believe that you have breached these Terms of Use, we may suspend or cancel your registration to MyCarFinance247 immediately at our reasonable discretion.
3.3 You may cancel your registration to MyCarFinance247 at any time by accessing https://www.carfinance247.co.uk/contact-us and requesting that such access to MyCarFinance247 is cancelled and if you do so, you must stop using MyCarFinance247 immediately.
3.4 For the avoidance of doubt, on cancellation of your registration, for any reason, any paragraphs of these Terms of Use, which expressly or by implication have effect after termination shall continue in full force and effect.
3.5 The suspension or cancellation of your registration and your right to use the MyCarFinance247 shall not affect either party's accrued rights or liabilities under these Terms of Use.
3.6 We reserve the right to delete your account and any personal data or other information associated with your use of the MyCarFinance247 if there is no activity on your account for more than thirty-six consecutive months.
4.1 We aim to update MyCarFinance247 regularly and may change the content at any time. If the need arises, we may suspend your access to MyCarFinance247 or close it indefinitely. The material on MyCarFinance247 may be out of date at any given time, and we are under no obligation to update such material.

5.2 If you choose to start a Web Chat session, we will guide you to the answer to your question within the web chat session. Where appropriate, during the Web Chat session, we will arrange contact with one of our customer service advisors.
5.3 Please be respectful when communicating with our customer service specialists. If your message is abusive or offensive, our customer service specialists have the right to end the relevant chat immediately.
5.4 Web Chat, WhatsApp Chat and SMS Chat are available twenty-four hours a day, but should you start a chat session outside of our normal business hours you may, in respect of Web Chat, receive an automated response confirming when you can expect to receive a response and, in respect of SMS Chat or WhatsApp Chat, receive a response as soon as possible on the following working day.
5.5 A record of each live chat (held via Web Chat, WhatsApp Chat, SMS Chat or any communication received by email, as applicable) will be held by us, and may be used by us: (i) when looking into your application; and/or (ii) for quality purposes (including, but not limited to, when you contact us using other methods set out in these Terms of Use), and in all instances will be held and used in accordance with our Privacy Policy. For your own security we would discourage you from disclosing any personal or account information when using Web Chat, WhatsApp Chat, SMS Chat and/or any other form of communication by you to us.
